On 19 July 2008, the Regional Council issued its decisions on submissions to the Proposed Regional Coastal Environment Plan (RCEP). The period for lodging appeals with the Environment Court against those decisions closed at the end of August 2008. There were 12 appeals lodged. Those appeals are now being addressed through the Environment Court's processes.
Those parts of the Proposed RCEP which are not subject to appeal are 'beyond challenge' and can be regarded as being operative. However, one appeal is opposing the entire plan and is asking the Environment Court to withdraw (ie: effectively delete) the entire plan.
The latest version of the Proposed RCEP indicates the Council's interpretation of those provisions are still subject to one or more appeals.
As the appeals are processed and issues resolved, parts of the Proposed RCEP will move 'beyond challenge'. The Proposed RCEP will be updated regularly as each of the appeal topics is resolved beyond legal challenge.
NOTE: The purpose of updating the Proposed RCEP is to assist users of the Plan to keep up to date with changes as appeals are resolved. However, should there be any uncertainty as to whether or not the wording in this document correctly reflects the resolution of appeals, users should refer to the original decision document and the wording of any documents issued by the Environment Court.
