The Council has given public notice of the availability of the ‘Summary of Decisions Requested”. The public notice signals the start of the further submission period and gives people 10 working days to make a further submission to the Council.

The Hawke’s Bay Regional Council has prepared a summary of decisions requested by submitter or by plan topic for Variation 1. Further submissions are now invited in support or opposition to the original submissions received.
Any person representing a relevant aspect of the public interest, or who has an interest in Variation 1 greater than the general public may make a further submission. You do not need to have made an original submission to be eligible to make a further submission. However further submissions can only support or oppose part or all of an original submission on Variation 1 - No new issues can be introduced. Further submissions must be made on Council’s Further Submission Form or Form 6 of the Resource Management Act (Forms, Fees and Procedure) regulations 2003 or an equivalent. Full copies of the submissions can be viewed at Council Offices, or public libraries within the Region.

Variation 1 proposes to currently remove and reintroduce the rivermouth hazard areas as part of Coastal Hazard Zone 1 (CHZ1) in the RECP. Each of the rivermouth hazard areas that is being deleted from CHZ1 is being reinstated into CHZ1.
The purpose of the Variation is to create a process which provides a clear opportunity for potentially affected landowners to submit and debate the technical reasons for the rivermouth hazard area on their properties.
Following the receipt of further submissions, hearings will be held to consider all submissions. The hearings give those submitters who have indicated that they wish to be heard, an opportunity to talk about their concerns and provide evidence in support of their submissions. At the hearings, submitters will be given a chance to explain their submission and/or further submissions and may be asked questions about their views.
After the hearings, the Council will consider all the information put forward in written and verbal submissions. It may accept each submission point in full or in part, or the points may be rejected. Variation 1 will be amended as a result of this consultation and decision making process. If submitters are unhappy with any decision made as a result of their submissions, they may appeal the Council’s decision to the Environment Court.
