Proposed Plan Change for On-Site Domestic Wastewater

Hawke’s Bay Regional Council has proposed amendments to existing rules controlling discharges of domestic wastewater on private land. 

'Change 3' proposes amendments to the Hawke's Bay Regional Resource Management Plan

'Variation 3' proposes amendments to the proposed Hawke's Bay Regional Coastal Environment Plan

The Regional Council has decided that these proposed amendments will not come into force immediately. Instead, the amended rules in Change 3 and Variation 3 will not come into force until after hearings have been held, decisions on submissions are issued and any subsequent appeals are resolved.

The amendments propose an approach which focuses on locations where discharges from waste water systems present a higher risk to the environment – such as sloping sections or near waterways.  This would replace the rather blunt approach currently in the rules which is based on zoning.  As currently proposed, the changes will mean a large number of people who previously required resource consent will no longer need one. Conversely, some people who previously did not require a discharge permit will need to obtain one.  People with systems installed since 2000 would not need to apply for a resource consent.

Next Steps

A hearing was held on 29 April 2012. Decisions will be issued in the near future. Submitters have the right to appeal these decisions to the Environment Court.
